Serious medical concerns !

We have just been informed by Server Mustafayev’s lawyer that his health is of great concern, with continued high fever and a dry cough, and that he is still not receiving adequate medical help. On the contrary, he is being obliged to attend court hearings. Server Mustafayev’s next court hearing on extending his pre-trial restrictions is expected to take place on Monday 23 March. Server Mustafayev has been asking to be tested for COVID-19.

On 19 March in the morning, Server Mustafayev had a fever and given a fever-reducing injection before being transferred to court. However, his fever went up again after several hours and a paramedic was brought into court to assist him – again injecting him a fever-reducing drug. The court hearing for Server Mustafayev was stopped, but not for his co-defendants. At around 4 pm he was removed from the court room, but the lawyer is afraid that Server Mustafayev wasn’t immediately transferred to the SIZO and continued to wait for other co-defendants. If so, the lawyer thinks he would have been transferred to SIZO only at around 11pm with the rest of the co-defendants, which is very disturbing in his condition.

In light of Server Mustafayev’s situation, also considering the COVID-19 risks for him and other prisoners, we are urging the authorities to:

  • Immediately and unconditionally released Server Mustafayev;
  • In the meantime, to ensure he is urgently provided with adequate medical care and that next Monday’s court hearing is postponed.


Failure to provide adequate medical care to prisoners may violate the absolute prohibition of torture and other cruel, inhuman or degrading treatment or punishment, including under Article 7 of the International Covenant on Civil and Political Rights. This is particularly true when such failure is the result of a deliberate act by officials.
